Official Rules
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. ODDS OF WINNING A PRIZE DEPEND UPON THE NUMBER OF ELIGIBLE ENTRIES RECEIVED DURING THE ENTRY PERIOD.
OPEN ONLY TO ELIGIBLE RESIDENTS OF THE 50 UNITED STATES AND DISTRICT OF COLUMBIA WHO, AS OF THE TIME OF ENTRY, ARE AT LEAST 18 YEARS OLD (OR THE AGE OF MAJORITY IN THEIR JURISDICTION OF RESIDENCE IF HIGHER THAN 18) AND, AS OF THE DATE PRIZES ARE AWARDED, A PART-TIME OR FULL-TIME EMPLOYEE OR PART-TIME OR FULL-TIME CONTRACTOR OF A PARTICIPATING CORPORATE ENTITY AS ANNOUNCED BY DAILYPAY THROUGH AN AUTHORIZED DAILYPAY COMMUNICATION.
VOID IN PUERTO RICO AND ALL JURISDICTIONS OTHER THAN THOSE STATED ABOVE AND WHERE PROHIBITED OR RESTRICTED BY LAW.

Entrants acknowledge and agree that the Sweepstakes are not sponsored, endorsed, or administered by, or associated with Your Employer, Apple or Google. No Apple or Google products are being used as Prizes. You agree to release Your Employer, Apple, Google and Sponsor and all other Sweepstakes Parties from all claims arising out of or in connection with the Sweepstakes. Any questions, comments or complaints regarding this Sweepstakes should be directed to Sponsor and not to Your Employer, Apple or Google.
DailyPay’s July Savings Boost Sweepstakes (the “Sweepstakes”) is open only to individuals who are (i) eighteen (18) years of age or older (or the age of majority in their jurisdiction of residence if higher than 18) at the time of entry, (ii) as of the date prizes are awarded, part-time or full-time employees or part-time or full-time contractors of a participating corporate entity as announced by DailyPay through an authorized DailyPay communication (“Your Employer”), and (iii) residents of the fifty (50) United States or the District of Columbia (“Eligible Employee”). Void in Puerto Rico and all jurisdictions other than those stated above and where prohibited or restricted by law. The following individuals are not eligible to enter or win a prize: directors, officers, employees, contractors, representatives, and agents of DailyPay, Inc. (“Sponsor”), and its parents, subsidiaries, or affiliated companies, marketing agencies, and any other parties involved in the administration of the Sweepstakes (Sponsor, collectively with the foregoing, the “Sweepstakes Parties”) and each of the immediate family members of such excluded individuals (i.e., spouses, parents, children, siblings and the “steps” of each) and all persons living in the same household of each. By participating in this Sweepstakes, entrants agree to be bound by these official rules (“Official Rules”) and by the decisions of the Sponsor, which shall be final in all matters relating to the Sweepstakes.
The entry period for this Sweepstakes starts on July 15th, 2024 at 12:00:00 AM ET and ends on July 31st, 2024 at 11:59:59 PM ET (“Entry Period”). Sponsor’s computer is the official time keeping device for the Sweepstakes.
NO PURCHASE NECESSARY AND NO ENTRY FEE, PAYMENT OR PROOF OF PURCHASE IS NECESSARY TO PARTICIPATE.
An Eligible Employee may use one method to enter the Sweepstakes. The method of entry (“Method 1”) requires you to register for or maintain for a DailyPay account and enter to participate in this Sweepstakes.
Method 1: DailyPay Account Registration and Sweepstakes Entry
Step 1: During the Entry Period, download the DailyPay mobile application (available on iPhone and Android) (the “DailyPay App”).
Step 2: Create a DailyPay account or log on to your DailyPay account if you already have one.
Step 3: Enter into the Sweepstakes using the DailyPay App
You will receive one (1) entry for completing the foregoing steps. If you already have the DailyPay App and a DailyPay account, you only need to complete step 3 to receive an entry.
Additional Entry Methods
If you complete Method 1, you will receive one (1) additional entry for completing the Additional Entry Methods listed below, up to a total of two (2) entries.
Additional Method: Follow @DailyPay on Instagram and comment a goal you have for this year before the summer ends on Instagram during the time period starting with your completion of Method 1 through July 31, 2024.
Each entrant may only use one (1) DailyPay account to enter the Sweepstakes and must comply with DailyPay’s Terms of Service available at https://www.dailypay.com/legal/site-terms (the “DailyPay Terms”).
Compliance with the entry requirements will be determined by Sponsor in its sole discretion. Submissions that violate these entry requirements, as determined by the Sponsor, in its sole discretion, will be disqualified from the Sweepstakes.
Entrants must be the authorized account holder of the e-mail address used to register for the DailyPay account. The “Authorized Account Holder” is defined as the natural person to whom the e-mail address is assigned by an internet service provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. In the event of a discrepancy between the identity of the Authorized Account Holder, the “winner,” and the entrant, Sponsor reserves the right, in its sole discretion, to determine whether the entry is valid or to declare the entry invalid and select a substitute winner from a random drawing of all remaining eligible entries.
Odds of winning depend on number of entries received.
On or about August 6th, 2024, one hundred (100) winners will be randomly selected from among all eligible entries received during the Entry Period. On or about August 12th, 2024, Sponsor will attempt to notify all winners via the email address associated with each winner’s DailyPay account.
Each winner will receive their prize in the form of an increase to their available balance in their DailyPay account. If any winner does not have a bank account or debit card linked to their DailyPay account, such winner will need to link a bank account or debit card to their DailyPay account in order to withdraw the prize amount from their DailyPay account. If any winner does not claim their prize and withdraw the prize amount from their DailyPay account within ninety (90) days of issuance, then such winner will forfeit the prize.

The total aggregate retail value (“ARV”) for all prizes offered in the Sweepstakes is $2,500.
Your use of your DailyPay account is subject to the DailyPay Terms. Sponsor reserves its right, in its sole discretion, to delay, suspend, or terminate any user’s access to their DailyPay account if such user violates the DailyPay Terms. As a condition of receiving the prize, a winner must not have had their DailyPay account delayed, suspended, or terminated at any time prior to the prizes being delivered. If such winner’s DailyPay account has been delayed, suspended or terminated, such winner forfeits their prize and Sponsor reserves the right to select a new winner among the remaining eligible entries.
The method of delivery of the prize will be determined in the sole discretion of Sponsor. Sponsor is not responsible for any prizes that are lost, stolen, undeliverable, or returned.
Each winner’s rights to receive the prize are subject to verification of eligibility, including verification of age, residency, and employment status with Your Employer.
The right to receive the prize cannot be transferred, assigned or redeemed for cash. The prize is non-transferable and no cash or other prize substitution is permitted, except at the sole discretion of the Sponsor. The prize is subject to availability and if the prize cannot be awarded, for any reason, Sponsor reserves the right in its sole discretion to substitute a prize with one of comparable or greater retail value.
Each winner is solely responsible for all federal, state, local, or other applicable taxes associated with the acceptance and use of the prize. If any winner wins an aggregate amount of $600 or more in ARV in prizes from sweepstakes sponsored by the Sponsor in the calendar year 2024 (including, without limitation, the Sweepstakes), then such winner may be issued an IRS Form 1099-MISC in the amount of the approximate retail value of the prize(s) (as calculated by Sponsor) and must provide Sponsor with their valid Social Security Number or Taxpayer ID for tax reporting purposes upon request. As a condition of receiving the prize, Winner must sign and return any documents requested by Sponsor, including but not limited to, an affidavit of eligibility and release of liability. Noncompliance with the requirements of this paragraph will result in disqualification of the winner and the forfeiture of all interest in the prize.
All costs and expenses associated with prize acceptance and use not specifically provided herein are the responsibility of each winner.
Except where prohibited by law, by accepting a prize, the winner hereby grants Sponsor and its licensees a perpetual, worldwide, royalty-free, non-exclusive and sub-licensable right and license to use, distribute, and publicly display the winner’s name, hometown, and likeness in any way, at any time, in any and all media, including for use in advertising and marketing, without limitation, without any additional approval or consideration.
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE (I) SPONSOR AND THE OTHER SWEEPSTAKES PARTIES SHALL NOT BE RESPONSIBLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR SPECIAL DAMAGES ARISING OUT OF OR CONNECTED WITH (A) THE SWEEPSTAKES OR (B) ANY PRIZE AWARDED, AND (II) YOUR REMEDIES FOR ANY CLAIMS RELATING THE SWEEPSTAKES ARE LIMITED TO YOUR ACTUAL OUT-OF-POCKET EXPENSES OF PARTICIPATION IN THE SWEEPSTAKES (IF ANY).
The Sweepstakes Parties assume no liability and are not responsible for, and by entering the Sweepstakes or claiming or accepting any prize, you hereby waive and release the Sweepstakes Parties and Your Employer from, any actions, claims, damages, losses or injuries of any kind (collectively “Claims”) arising in connection with the Sweepstakes and/or the receipt, use or misuse of any prize, including without limitation, Claims relating to: (i) the malfunction of any computer, telephone, network, satellite, hardware, software or communications line; (ii) unauthorized human intervention; (iii) incorrect, delayed or inaccurate transmission, winner notifications, prize claims or other information or communications relating to the Sweepstakes, or the failure to capture or transmit any such information; (iv) damage to any person’s computer or mobile device; or (v) any errors in these Official Rules, winner notifications or other announcements or communications relating to the Sweepstakes. In the event of any ambiguity or error(s) in these Official Rules, Sponsor reserves the right to clarify or modify these Official Rules however it deems appropriate to correct any such ambiguity or error(s). If due to an error or for any other reason, more legitimate prize claims are received than the number of prizes stated in these Official Rules, Sponsor reserves the right to award only 100 prizes from a random drawing of all eligible entries. In no event will more than the stated maximum number of prizes (i.e., 100 prizes) be awarded.
LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT A PARTICIPANT, TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND PURSUE ALL OTHER REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
Sponsor may prohibit an entrant from participating in the Sweepstakes or winning the prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or any Sweepstakes Parties.
If the Sweepstakes is not capable of running as planned, for any reason, including without limitation, due to a force majeure event or infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, government orders, natural disasters, the effects of COVID-19 or any pandemic or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor reserves the right, at its sole discretion, to modify, suspend, or cancel the Sweepstakes. In the event of cancellation, Sponsor reserves the right to select a winner from a random drawing of all non-suspect, eligible entries submitted as of the time of cancellation or retain any and all prizes.
Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, the rights and obligations of entrants and winners, and the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules, and the forum and venue for any dispute relating to this Sweepstakes shall be in New York County, New York. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. If any provision of these Official Rules is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced.
Any personally identifiable information collected during an entrant’s participation in the Sweepstakes will be collected and used by Sponsor and its designees for the administration and fulfillment of the Sweepstakes and as otherwise described in these Official Rules and Sponsor’s privacy policy available at https://www.dailypay.com/legal/privacy.
