1. Sponsor. DailyPay, LLC, 55 Water St., 42nd Floor, New York, NY, 10041 (“Sponsor” or “DailyPay”).
2. Eligibility. The DailyPay DPC Eligible April Sweepstakes (the “Sweepstakes”) is open only to individuals who: (i) are eighteen (18) years of age or older (or the age of majority in their jurisdiction of residence if higher than 18) at the time of entry; (ii) are residents of the 50 United States or the District of Columbia; (iii) have an active DailyPay account or are eligible to enroll in DailyPay at the time of entry and prize fulfillment; and (iv) are sent and receive an email from Sponsor about the Sweepstakes. The following individuals are not eligible to enter or win a Prize: (i) directors, officers, employees, contractors, representatives, and agents of Sponsor, and its parents, subsidiaries, or affiliated companies, marketing agencies, and any other parties involved in the administration of the Sweepstakes (Sponsor, collectively with the foregoing, the “Sweepstakes Parties”), (ii) any officer or employee of the U.S. government or a public sector employer, including without limitation, public and private K-12 educational institutions, and state owned higher educational institutions, and (iii) each of the immediate family members of such excluded individuals (i.e., spouses, parents, children, siblings and the “steps” of each) and all persons living in the same household of each. By participating in the Sweepstakes, entrants agree to be bound by these official rules (“Official Rules”) and by the decisions of the Sponsor, which shall be binding and final in all matters relating to the Sweepstakes.
3. Sweepstakes Entry Period. The Sweepstakes begins on April 6, 2026 at 12:00 AM ET and ends on May 1, 2026 at 11:59 PM ET (“Sweepstakes Period”). Sponsor’s system is the official time keeping device for the Sweepstakes.
4. How to Enter. To enter the Sweepstakes, eligible individuals must complete any one or more of the following methods of entry during the Sweepstakes Period:
(i) Automatic Entry: Eligible individuals will receive one (1) automatic entry to the Sweepstakes per successfully completed action below using their DailyPay account. Limit of one (1) automatic entry per completed action.
(ii) Email Entry: To enter the Sweepstakes without using your DailyPay account, eligible individuals may email [email protected] with “DailyPay DPC Eligible April Sweepstakes” in the email title, with their full name and contact email address for one (1) entry to the Sweepstakes. Limit of five (5) email entries per person.
Limit of five (5) entries to the Sweepstakes per person, regardless of method of entry. Sponsor may disqualify entries that, in Sponsor’s sole and absolute discretion: (i) are generated by script, computer programs, macro, programmed, robotic or other automated means; (ii) are in excess of the stated limit(s), incomplete, illegible, corrupted, damaged, destroyed, forged, false, lost, late or misdirected, deceptive; or (iii) do not conform to or violate these Official Rules or are submitted in any manner other than stated in these Official Rules.
5. Winner Selection and Odds. On or about May 5, 2026, twenty-five (25) potential winners will be selected from all eligible entries received via random drawing. Odds of winning the Sweepstakes depend on the total number of eligible entries received during the Sweepstakes Period.
6. Winner Notification. The potential winners will be notified by e-mail on or about May 5, 2026. In the event of any dispute concerning the identity of any entrant, the entry will be deemed submitted by the person who is the authorized account holder of the email address associated with the entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. In the event a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible.
The Sweepstakes Parties are not responsible for and shall not be liable for: (i) false, incorrect, changed, incomplete or illegible contact information; (ii) electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant’s email or other account to receive messages; or (iii) late, lost, damaged, intercepted, misdirected, or unsuccessful efforts to notify potential winners.
7. Prize. Each of the twenty-five (25) Winners (defined below) will receive $100 USD added to their DailyPay Available Earnings (each, a “Prize), approximate retail value (“ARV”) $100 USD each. “DailyPay Available Earnings” means the On-Demand Pay balance that may be accessed by a DailyPay user before their next payday. Total ARV of all Prizes to be awarded is $2,500 USD. Limit of one (1) Prize per person. Use of the Prize is subject to the DailyPay Program terms available at https://www.dailypay.com/en-us/legal/program-terms/ (the “Program Terms”). No more than the stated number of Prizes set forth in these Official Rules will be awarded.
8. Prize Fulfillment: The potential winners are subject to verification of eligibility and compliance with these Official Rules prior to being declared a winner (each a “Winner”,
collectively the “Winners”) and the award of the Prize. Prizes will be added to Winners’ Available Earnings on or about June 5, 2026. Each Winner must transfer their Prize from their Available Earnings to an external account by September 1, 2026 at 11:59PM ET. If a Winner does not transfer the Prize to an external account prior to September 1, 2026 at 11:59PM ET, the Prize will expire and be removed from the Winner’s DailyPay Available Earnings without any compensation to the Winner. If a Winner does not have a DailyPay account at the time of Prize fulfillment to accept the Prize, Sponsor will provide the Prize to the Winner via a check in the amount of $100 USD by mail to the address provided by the Winner or in another mutually agreed upon method on or about July 3, 2026. Sponsor is not responsible for any Prizes that expire or are lost, stolen, undeliverable, or returned. The right to receive a Prize cannot be transferred, assigned or redeemed for cash. Prizes are non-transferable and no cash or other prize substitution is permitted, except at the sole discretion of the Sponsor. If a Prize cannot be awarded, for any reason, Sponsor reserves the right in its sole discretion to substitute a Prize with one of comparable or greater retail value.
Each Winner is solely responsible for all federal, state, local, or other applicable taxes associated with the acceptance and use of a Prize and must provide Sponsor with their valid Social Security Number or Taxpayer ID for tax reporting purposes upon request. As a condition of receiving a Prize, each Winner must sign and return any documents requested by Sponsor, including but not limited to, an affidavit of eligibility, a release of liability, and where lawful, a publicity release. All costs and expenses associated with Prize acceptance and use not specifically provided herein are the responsibility of each Winner.
If a Winner does not comply with these Official Rules, cannot be reached, is found to be ineligible, or declines acceptance of the Prize for any reason, such Winner will be disqualified and will forfeit all interest in a Prize without any compensation to the Winner, and an alternate winner may be selected.
9. Publicity. Except where prohibited by law, by accepting a Prize, each Winner hereby grants Sponsor and its licensees a perpetual, worldwide, royalty-free, non-exclusive and sub-licensable right and license to use, distribute, and publicly display the Winner’s name, hometown, and likeness in any way, at any time, in any and all media, including for use in advertising and marketing, without limitation, without any additional approval or consideration.
10. Limitations of Liability of Sweepstakes Parties. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE (I) THE SWEEPSTAKES PARTIES SHALL NOT BE RESPONSIBLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR SPECIAL DAMAGES ARISING OUT OF OR CONNECTED WITH (A) THE SWEEPSTAKES OR (B) ANY PRIZE AWARDED, AND (II) YOUR REMEDIES FOR ANY CLAIMS RELATING THE SWEEPSTAKES ARE LIMITED TO YOUR ACTUAL
OUT-OF-POCKET EXPENSES OF PARTICIPATION IN THE SWEEPSTAKES (IF ANY). The
Sweepstakes Parties assume no liability and are not responsible for, and by entering the Sweepstakes or claiming or accepting any Prize, you hereby waive and release the Sweepstakes Parties from, any actions, claims, damages, losses or injuries of any kind (collectively “Claims”) arising in connection with the Sweepstakes and/or the receipt, use or misuse of any Prize, including without limitation, Claims relating to: (i) the malfunction of any computer, telephone, network, satellite, hardware, software or communications line; (ii) unauthorized human intervention; (iii) incorrect, delayed or inaccurate transmission, Winner notifications, Prize claims or other information or communications relating to the Sweepstakes, or the failure to capture or transmit any such information; (iv) damage to any person’s computer or mobile device; or (v) any errors in these Official Rules, Winner notifications or other announcements or communications relating to the Sweepstakes. In the event of any ambiguity or error(s) in these Official Rules, Sponsor reserves the right to clarify or modify these Official Rules however it deems appropriate to correct any such ambiguity or error(s).
11. Conduct. LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND PURSUE ALL OTHER REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST
EXTENT PERMITTED BY LAW. Sponsor may prohibit an entrant from participating in the Sweepstakes or winning a Prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, deception, or other unfair playing practices (including attempts made by the same individual to receive entries in excess of the stated limit(s) by using multiple or false contact information, accounts or otherwise) or acting in an unsportsmanlike, obscene, immoral, or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person.
12. Sponsor’s Reservation of Rights. If the Sweepstakes is not capable of running as planned, for any reason, including without limitation, due to a force majeure event or infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, government orders, natural disasters, the effects of COVID-19 or any pandemic or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor reserves the right, at its sole discretion, to modify, suspend, or cancel the Sweepstakes. In the event of cancellation, Sponsor reserves the right to select Winners from a random drawing of all non-suspect, eligible entries submitted as of the time of cancellation or retain any and all Prizes.
13. Governing Law. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, the rights and obligations of entrants and Winners, and the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules, and the forum and venue for any dispute relating to this Sweepstakes shall be in New York County, New York. Sponsor’s
failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. If any provision of these Official Rules is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced.
14. Privacy. Any personally identifiable information collected during an entrant’s participation in the Sweepstakes will be collected and used by Sponsor and its designees for the administration and fulfillment of the Sweepstakes, and as otherwise described in these Official Rules and Sponsor’s privacy policy available at https://www.dailypay.com/legal/privacy.
15. Winner List. For the names of the Winners, send an email to [email protected] with “DailyPay DPC Eligible April Sweepstakes” in the subject line. Requests must be received no later than sixty (60) days after the end of the Sweepstakes Period.
