Official Rules
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. ODDS OF WINNING A PRIZE DEPEND UPON THE NUMBER OF ELIGIBLE ENTRIES RECEIVED DURING THE ENTRY PERIOD.
DailyPay, LLC, 55 Water St., 42nd Floor, New York, NY, 10041 (“Sponsor” or “DailyPay”).
Entrants acknowledge and agree that the Sweepstakes is not sponsored, endorsed, or administered by, or associated with Your Employer, Apple, Google or Meta, or Instagram. No Apple, Google, Meta or Instagram products are being used as Prizes. You agree to release Your Employer, Apple, Google, Sponsor, Meta, Instagram and all other Sweepstakes Parties from all claims arising out of or in connection with the Sweepstakes. Any questions, comments or complaints regarding this Sweepstakes should be directed to Sponsor and not to Your Employer, Apple, Google, Meta, or Instagram.
DailyPay’s Refer a coworker Instagram Giveaway November 2025 (the “Sweepstakes”) is open only to individuals who (i) are eighteen (18) years of age or older (or the age of majority in their jurisdiction of residence if higher than 18) at the time of entry, (ii) are, as of the date prizes are awarded, part-time or full-time employees or part-time or full-time contractors of a participating corporate entity as announced by DailyPay through an authorized DailyPay communication (“Your Employer”), (iii) are residents of the fifty (50) United States or the District of Columbia and (iv) have an active DailyPay account (individuals meeting such criteria under (i) through (iv), a “User”). Void in Puerto Rico and all jurisdictions other than those stated above and where prohibited or restricted by law. The following individuals are not eligible to enter or win a prize: directors, officers, employees, contractors, representatives, and agents of DailyPay, LLC (“Sponsor”), and its parents, subsidiaries, or affiliated companies, marketing agencies, and any other parties involved in the administration of the Sweepstakes (Sponsor, collectively with the foregoing, the “Sweepstakes Parties”) and each of the immediate family members of such excluded individuals (i.e., spouses, parents, children, siblings and the “steps” of each) and all persons living in the same household of each. By participating in this Sweepstakes, entrants agree to be bound by these official rules (“Official Rules”) and by the decisions of the Sponsor, which shall be final in all matters relating to the Sweepstakes.
The entry period for this Sweepstakes starts on November 3, 2025 at 4:00:00 PM ET and ends on November 7, 2025 at 11:59:59 PM ET (“Entry Period”). Sponsor’s computer is the official time keeping device for the Sweepstakes.
NO PURCHASE NECESSARY AND NO ENTRY FEE, PAYMENT OR PROOF OF PURCHASE IS NECESSARY TO PARTICIPATE.
A user may use one method to enter the Sweepstakes. The method of entry requires you to like the designated @dailypay post, follow the DailyPay Instagram account, and tag three coworkers in the comment section of the designated post. Limit of one (1) entry per person.
Step 1: Like the designated post.
Step 2: Follow the @dailypay Instagram account.
Step 3: Tag three coworkers in the comments on the designated @dailypay entry post, which will be live on or around November 3rd, 2025 – November 7th, 2025.
You will receive an entry for completing the foregoing steps within the Entry Period. The entrant must be active on the DailyPay App and have a DailyPay account to be eligible to win the Sweepstakes.
On or about November 11, 2025, a Winning User who meets the criteria will be identified from among all eligible entries received during the Entry Period. The Winning User will be selected at random and will be notified by direct message on Instagram and/or email. The coworkers tagged by that Winning User shall be the Winning Coworkers. The Winning User and Winning Coworkers are collectively referred to as the “Winners.”
The Winning User will receive a Prize with an approximate retail value (“ARV”) of $500 USD. The Winning Coworkers mentioned in the comments will each receive a Prize with an approximate retail value (“ARV”) of $100 each. The specific form of the Prize will depend on the recipient’s DailyPay account status at the time of prize fulfillment:
Total approximate retail value (“ARV”) of all Prizes to be awarded is $800 USD ($500 for entrant and $100 each for their three coworkers mentioned in the Instagram comment section). Limit of one (1) Prize per person. No more than the stated number of Prizes set forth in these Official Rules will be awarded.
Prize Fulfillment: Prizes will be fulfilled within 2 weeks after the drawing date (on or about November 25, 2025).
Prize Expiration (for funds added to DailyPay Available earnings): Any Prize funds added to a Winner’s DailyPay Available earnings will expire four (4) weeks after being added if not transferred out by the Winner.
Prize Expiration (for Reachdesk gift card): You must redeem the gift card within 30 days of receiving, or the funds awarded and redemption link will expire.
Your use of your DailyPay account is subject to the DailyPay terms. Sponsor reserves its right, in its sole discretion, to delay, suspend, or terminate any user’s access to their DailyPay account if such user violates the DailyPay terms. As a condition of receiving the prize, a Winning User must not have had their DailyPay account delayed, suspended, or terminated at any time prior to the prizes being delivered. If such Winning User’s DailyPay account has been delayed, suspended or terminated, such Winning User forfeits their prize (and the prize for any Winning Coworker) and Sponsor reserves the right to select a new Winning User from among the remaining eligible entries.
Each Winning User’s rights to receive the prize are subject to verification of eligibility, including verification of age, residency, and employment status with Your Employer.
The right to receive the prizes cannot be transferred, assigned or redeemed for cash. The prizes are non-transferable and no cash or other prize substitution is permitted, except at the sole discretion of the Sponsor. The prizes are subject to availability and if a prize cannot be awarded, for any reason, Sponsor reserves the right in its sole discretion to substitute a prize with one of comparable or greater retail value.
Each Winner is solely responsible for all federal, state, local, or other applicable taxes associated with the acceptance and use of the prize. If any Winner wins an aggregate amount of $600 or more in ARV in prizes from sweepstakes sponsored by the Sponsor in the calendar year 2025 (including, without limitation, the Sweepstakes), then such Winner may be issued an IRS Form 1099-MISC in the amount of the approximate retail value of the prize(s) (as calculated by Sponsor) and must provide Sponsor with their valid Social Security Number or Taxpayer ID for tax reporting purposes upon request. As a condition of receiving a prize, Winners must sign and return any documents requested by Sponsor, including but not limited to, an affidavit of eligibility and release of liability. Noncompliance with the requirements of this paragraph will result in disqualification of the Winner and the forfeiture of all interest in the prize.
All costs and expenses associated with prize acceptance and use not specifically provided herein are the responsibility of each Winner.
Except where prohibited by law, by accepting a prize, each Winner hereby grants Sponsor and its licensees a perpetual, worldwide, royalty-free, non-exclusive and sub-licensable right and license to use, distribute, and publicly display the Winner’s name, hometown, and likeness in any way, at any time, in any and all media, including for use in advertising and marketing, without limitation, without any additional approval or consideration.
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE (I) SPONSOR AND THE OTHER SWEEPSTAKES PARTIES SHALL NOT BE RESPONSIBLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR SPECIAL DAMAGES ARISING OUT OF OR CONNECTED WITH (A) THE SWEEPSTAKES OR (B) ANY PRIZE AWARDED, AND (II) YOUR REMEDIES FOR ANY CLAIMS RELATING THE SWEEPSTAKES ARE LIMITED TO YOUR ACTUAL OUT-OF-POCKET EXPENSES OF PARTICIPATION IN THE SWEEPSTAKES (IF ANY).
The Sweepstakes Parties assume no liability and are not responsible for, and by entering the Sweepstakes or claiming or accepting any prize, you hereby waive and release the Sweepstakes Parties,Your Employer, Meta and Instagram from, any actions, claims, damages, losses or injuries of any kind (collectively “Claims”) arising in connection with the Sweepstakes and/or the receipt, use or misuse of any prize, including without limitation, Claims relating to: (i) the malfunction of any computer, telephone, network, satellite, hardware, software or communications line; (ii) unauthorized human intervention; (iii) incorrect, delayed or inaccurate transmission, winner notifications, prize claims or other information or communications relating to the Sweepstakes, or the failure to capture or transmit any such information; (iv) damage to any person’s computer or mobile device; or (v) any errors in these Official Rules, winner notifications or other announcements or communications relating to the Sweepstakes. In the event of any ambiguity or error(s) in these Official Rules, Sponsor reserves the right to clarify or modify these Official Rules however it deems appropriate to correct any such ambiguity or error(s). If due to an error or for any other reason, more legitimate prize claims are received than the number of prizes stated in these Official Rules, Sponsor reserves the right to award only 100 prizes from a random drawing of all eligible entries. In no event will more than the stated maximum number of prizes (i.e., 10 prizes) be awarded.
LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT A PARTICIPANT, TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND PURSUE ALL OTHER REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
Sponsor may prohibit an entrant from participating in the Sweepstakes or winning the prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or any Sweepstakes Parties.
If the Sweepstakes is not capable of running as planned, for any reason, including without limitation, due to a force majeure event or infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, government orders, natural disasters, the effects of COVID-19 or any pandemic or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor reserves the right, at its sole discretion, to modify, suspend, or cancel the Sweepstakes. In the event of cancellation, Sponsor reserves the right to select a winner from a random drawing of all non-suspect, eligible entries submitted as of the time of cancellation or retain any and all prizes.
Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, the rights and obligations of entrants and winners, and the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules, and the forum and venue for any dispute relating to this Sweepstakes shall be in New York County, New York. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. If any provision of these Official Rules is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced.
Any personally identifiable information collected during an entrant’s participation in the Sweepstakes will be collected and used by Sponsor and its designees for the administration and fulfillment of the Sweepstakes, including by Reachdesk for fulfillment of the Prizes in accordance with its privacy policy available at https://reachdesk.com/policy-center, and as otherwise described in these Official Rules and Sponsor’s privacy policy available at https://www.dailypay.com/legal/privacy.
For the name of the winner(s), send an email to social@dailypay.com with “Refer a Coworker Instagram Giveaway November 2025 Terms” in the subject line. Requests must be received no later than sixty (60) days after the end of the Entry Period.
